2012 Town Meeting Warrant

 

NOTICE: The voting by secret ballot will be held between 10:00 am and 5:30 pm, Monday, March 5th, 2012. Articles 3 through 62 will be taken up at 7:30 pm the same day.

 

Lincoln ss: to Stephen Gaudette, Constable of the Town of Southport in the County of Lincoln: (or any other Constable of the Town of Southport).

 

Greetings: In the name of the State of Maine, you are hereby required to notify the voters of the Town of Southport, in said County qualified by law to vote in Town affairs, to meet at the Southport Town Hall in said Town on Monday the fifth day of March, AD 2012, at 10:00 in the forenoon to act on the following articles to wit:

 

Art. 1. To choose a Moderator to preside at said meeting.

Art. 2. To elect by secret ballot, in accordance with the vote of the Town, the following: a SELECTMAN, ASSESSOR, & OVERSEER OF THE POOR for a three year term, a TAX COLLECTOR for a three year term, a MEMBER OF THE SCHOOL COMMITTEE for a three year term, a MEMBER OF THE SCHOOL COMMITTEE to complete an unexpired two year term and a FIRE CHIEF for a three year term.

Art. 3. To elect two (2) members of the BOARD OF LIBRARY TRUSTEES for three year terms.

Art. 4. To elect two (2) members of the BOARD OF CEMETERY TRUSTEES for three year terms.

Art. 5. To elect three (3) members of the BUDGET COMMITTEE for three year terms.

Art. 6. To see if the Town will vote to pay the necessary sum for the SQUIRREL AND CAPITOL ISLAND REBATES.

Art. 7. To see what sum the Town will appropriate from the unit allocation and other revenues for ADMINISTRATION (Share in the Superintendent’s Office). School Committee recommends $19,723.00. Budget Committee recommends same. 2011 appropriation $19,420.00.

Art. 8. To see what sum the Town will appropriate from the unit allocation and other revenues for SCHOOL COMMITTEE. School Committee recommends $8,389.00. Budget Committee recommends same. 2011 appropriation $8,150.00.

Art. 9. To see what sum the Town will appropriate from the unit allocation and other revenues for SPECIAL EDUCATION OFFICE. School Committee recommends $8,323.00. Budget Committee recommends same. 2011 Appropriation $8,329.00

Art. 10. To see what sum the Town will appropriate from the unit allocation and other revenues for PRINCIPALS OFFICE. School Committee recommends $62,822.00. Budget Committee recommends same. 2011 appropriation $119,023.00.

Art. 11. To see what sum the Town will appropriate from the unit allocation and other revenues for INSTRUCTION. School Committee recommends $357,623.00. Budget Committee recommends same. 2011 appropriation $350,463.00.

Art. 12. To see what sum the Town will vote to appropriate from the unit allocation and other revenues for SPECIAL EDUCATION. School Committee recommends $48,062.00. Budget Committee recommends same. 2011 appropriation $65,126.00.

Art. 13. To see what sum the Town will appropriate from the unit allocation and other revenues for STUDENT BODY ACTIVITIES. School Committee recommends $9,700.00. Budget Committee recommends same. 2011 appropriation $8,500.00.

Art. 14. To see what sum the Town will appropriate from the unit allocation and other revenues for HEALTH (NURSES OFFICE). School Committee recommends $3,350.00. Budget Committee recommends same. 2011 appropriation $3,350.00.

Art. 15. To see what sum the Town will appropriate from the unit allocation and other revenues for TRANSPORTATION. School Committee recommends $34,555.00. Budget Committee recommends same. 2011 appropriation $33,886.00.

Art. 16. To see what sum the Town will appropriate from the unit allocation and other revenues for PLANT OPERATION AND MAINTENANCE. School Committee recommends $87,036.00. Budget Committee recommends same. 2011 appropriation $83,588.00.

Art. 17. To see what sum the Town will appropriate from the unit allocation and other revenues for FOOD SERVICE. School Committee recommends $35,078.00. Budget Committee recommends same. 2011 appropriation $36,644.00.

Art. 18. To see what sum the Town will appropriate from the unit allocation and other revenues for TUITION FEES. School Committee recommends $266,268.00. Budget Committee recommends same. 2011 appropriation $234,317.00.

Art. 19. To see what sum the Town will appropriate for the total cost of funding public education from kindergarten through grade 12 as described in the Essential Programs and Services Funding Act and to see what sum the Town will raise as the Town’s contribution to the total cost of funding public education from kindergarten through grade 12 as described in the Essential Programs and Services Funding Act in accordance with the Maine Revised Statutes, Title 2-A, section 15688. (The School Committee and Budget Committee recommend a total appropriation of $0.00 with a local contribution to be raised of $0.00 and a State contribution of $0.00.) 2011 appropriation $0.00

Explanation: The Town’s contribution to the total cost of funding public education from kindergarten through grade 12 as described in the state’s Essential Programs and Services Funding Act is the amount of money determined by state law to be the minimum that a municipality must raise in order to receive the full amount of state dollars.

Art. 20. To see what sum the Town will raise and appropriate in additional local funds (recommendation $940,929.00) which exceeds the state’s Essential Programs and Services funding model by $940,929.00 as required to fund the budget recommended by the School Committee. School Committee recommends $940,929.00. Budget Committee recommends same. 2011 appropriation $960,467.00

The School Committee and Budget Committee recommend $940,929.00 for additional local funds and gives the following reasons for exceeding the state’s Essential Programs and Services funding model by $940,929.00. Personnel Funding ratios and matrices, Plant Operation and Maintenance.

Explanation: The additional local funds are those locally raised funds over and above the Town’s local contribution to the total cost of funding public education from kindergarten through grade 12 as described in the Essential Programs and Services Funding Act that will help achieve the Town’s budget for educational purposes.

Art. 21. Total Budget Summary To see what sum the Town of Southport will authorize the School Committee to expend for the fiscal year beginning July 1, 2012 and ending June 30, 2013 from the Town’s contribution to the total cost of funding public education from kindergarten through grade 12 as described in the Essential Programs and Services Funding Act ($0.00) additional local funds for school purposes under the Maine Revised Statutes, Title 20-A, section 15690 ($870,929.00), unexpended balances ($70,000.00), tuition receipts and other receipts for the support of schools. School Committee recommends $940,929.00.Budget Committee recommends same. 2011-2012 appropriation $9960,467.00.

Art. 22. To see what sum the Town will vote to raise for the SCHOOL BUS FUND. Budget Committee recommends $10,000.00. 2011 appropriation $10,000.00.

Art. 23. To see what sum the Town will vote to raise for TOWN OFFICERS. Budget Committee recommends $67,725.00. 2011 appropriation $64,325.00.

Art. 24. To see what sum the Town will vote to raise for TOWN OFFICE OPERATION. Budget Committee recommends $71,050.00. 2011 appropriation $69,885.00.

Art. 25. To see what sum the Town will vote to raise for TOWN HALL OPERATION AND MAINTENANCE. Budget Committee recommends $16,050.00. 2011 appropriation $16,050.00.

Art. 26. To see what sum the Town will vote for CODE ENFORCEMENT. Budget Committee recommends appropriate 2011 earnings of $13,739.06 and raise $14,835.94 for a total of $28,575.00. 2011 appropriation $28,950.00.

Art. 27. To see what sum the Town will vote for the PLANNING AND APPEALS BOARDS. Budget Committee recommends appropriate 2011 earnings of $75.00 and raise $4,425.00 for a total of $4,500.00. 2011 appropriation $2,525.00

6B3a “A non-conforming structure that has not been expanded since January 1, 1989, may be replaced on its current footprint if the applicant is willing to forego the possibility of present or future 30% expansion. This agreement must be recorded at the Registry of Deeds.”

Art. 29. To see if the Town will vote to amend the LAND USE ORDINANCE as proposed by the Planning Board, posted in the Town Office and reviewed at a public hearing held at least two weeks prior to this meeting on January 25, 2012, to add Appendix B to the8, addressing small wind powered energy systems.

Art. 30. To see if the Town will vote to amend the LAND USE ORDINANCE as proposed by the Planning Board, posted in the Town Office and reviewed at a public hearing held at least two weeks prior to this meeting on January 25, 2012, to adopt a definition of and a moratorium on geothermal heat exchange wells.

Art. 31. To see what sum the Town will vote to raise for FIRE PROTECTION. Budget Committee recommends $42,750.00. 2011 appropriation $43,100.00.

Art. 32. To see what sum the Town will vote to raise for E911 MAINTENANCE. Budget Committee recommends $500.00. 2011appropriation $200.00.

Art. 33. To see what sum the Town will vote to raise for HYDRANT RENTAL. Budget Committee recommends $43,305.00. 2011 appropriation $43,305.00.

Art. 34. To see what sum the Town will vote to raise for STREETLIGHTS. Budget Committee recommends $17,000.00. 2011 appropriation $17,000.00.

Art. 35. To see what sum the Town will vote to raise for WORKMEN’S COMPENSATION. Budget Committee recommends $8,000.00. 2011 appropriation $8,000.00.

Art. 36. To see what sum the Town will vote to raise for DISTRICT NURSE. Budget Committee recommends $2,356.00. 2011 appropriation $3,652.00.

Art. 37. To see what sum the town will vote to raise for AMBULANCE SERVICE. Budget Committee recommends $8,044.00. 2011 appropriation $8,032.00.

Art. 38. To see what sum the Town will vote to raise for the CEMETERY DISTRICT. Budget Committee recommends $11,000.00. 2011 appropriation $9,000.00.

Art. 39. To see what sum the Town will vote for PUBLIC WORKS. Budget Committee recommends appropriate Local Road Assistance of $19,178.00 and raise $238,472.00 for a total of $257,650.00 . 2011 appropriation $258,950.00

Art. 40. To see if the Town will vote to raise a sum for the use of the LIBRARY TRUSTEES. Budget Committee recommends $55,000.00. 2011 appropriation $60,000.00.

Art. 42. To see if the Town will vote to raise a sum for the use of the MUSEUM TRUSTEES. Budget Committee recommends $5,800.00. 2011 appropriation $4,400.00.

Art. 43. To see if the Town will vote to raise a sum for SOCIAL SECURITY AND MEDICARE. Budget Committee recommends $20,000.00. 2011 appropriation $18,500.00.

Art. 44. To see if the Town will vote to raise a sum for the BOOTHBAY REGION REFUSE DISPOSAL DISTRICT. Budget Committee recommends $163,143.00. 2011 appropriation 160,845.00.

Art. 45. To see if the Town will vote to raise a sum for the BOOTHBAY REGION HUMANE SOCIETY. Budget Committee recommends $750.00. 2011 appropriation $750.00.

Art. 46. To see if the Town will vote to raise a sum for the TOWN POOR. Budget Committee recommends $2,000.00. 2011 appropriation $ 2,000.00.

Art. 47. To see if the Town will vote to raise a sum for the FIREWORKS FUND COMMITTEE. $1,000.00 requested, Budget Committee recommends $500.00. 2011 appropriation $500.00.

Art. 48. To see if the Town will vote to raise a sum for HEALTHY KIDS. $1,500.00 requested. Budget Committee recommends $1,500.00. 2011 appropriation $1,000.00.

Art. 49. To see if the Town will vote to raise a sum for NEW HOPE FOR WOMEN. $660.00 requested. Budget Committee recommends $660.00. 2011 appropriation $660.00.

Art. 50. To see if the Town will vote to raise a sum for BOOTHBAY REGION SENIOR CITIZENS. $500.00 requested. Budget Committee recommends $500.00. 2011 appropriation $500.00.

Art. 51. To see if the Town will vote to raise a sum for SPECTRUM GENERATIONS. $1,109.00 requested. Budget Committee recommends $1,109.00. 2011 appropriation $1,109.00

Art. 52. To see if the Town will vote to raise a sum for MID-COAST MAINE COMMUNITY ACTION. $535.00 requested. Budget Committee recommends $535.00. 2011 appropriation $535.00.

Art. 53. To see if the Town will vote to raise a sum for the BOOTHBAY REGION ALUMNI BAND. $200.00 requested. Budget Committee recommends $_200.00. 2011 appropriation $200.00.

Art. 54. To see if the Town will vote to raise a sum for CHANNEL 7. $5,000.00 requested. Budget Committee recommends $5,000.00. 2011 appropriation $5,000.00.

Art. 55. To see if the Town will vote to adopt changes to the HARBOR ORDINANCES as proposed at a public hearing on January 18, 2012 and pertaining to the Squirrel Island jurisdiction.

Art. 56. To see if the Town will vote to appropriate available funds of $157,670.76 from EXCISE TAX, INTEREST, BOAT EXCISE, INTEREST ON BACK TAXES, DOG FEES, FUNDS IN LIEU OF TAXES AND REVENUE SHARING to defray the total commitment. Budget Committee and Selectmen so recommend.

Art. 57. To see if the Town will vote to appropriate UNEXPENDED AND UNAPPROPRIATED BALANCES from individual accounts, a total of $41,694.11, to defray the total commitment. Budget Committee and Selectmen so recommend.

Art. 58. To see if the Town will vote to ACCEPT STATE FUNDS to be disbursed in the fiscal year beginning January 1, 2012 and ending December 31, 2012.

Art. 59. To see if the Town will vote to authorize the Selectmen to sell and convey MORTGAGE LIENS now held by the Town with rights of foreclosure running and, also, sell property acquired by mortgage liens.

Art. 60. To see if the Town will vote to EXCEED THE PROPERTY TAX CAP imposed by the State of Maine.

Art. 61. To see if the Town will fix a date when taxes are due and payable and fix a rate of interest to be charged on unpaid taxes after said date. Selectmen recommend taxes due September 30, 2012 interest to begin October 1, 2012 and rate to be 7%. 2011 voted September 30, October 1 and 7%.

Art. 62. To hear and accept the minutes taken at this meeting by the Town Clerk, act and transact anything related thereto.

 

The Registrar of Voters will hold office hours while the polls are open to correct any error in or change the name and address on the voting lists; to accept the registration of any person who became eighteen years of age after the close of registration prior to it; to accept new registrations and to accept new enrollments. A person who is not a registered voter may not vote in any elections.
