GENERAL SUMMARY BY ARTICLE OF THE ORDINANCE (as approved at the Town Meeting on March 1, 2010) Article I – General Provisions – Page 1 Change: “Harbor Advisory Committee” renamed “Harbor Committee” as it functions in more than an advisory capacity (harbor closures; multiple moorings)
Article II – Definitions – Pages 2-4 Changes: Definitions not found in ordinance removed; definitions used in ordinance added. Article III – General Boating and Traffic Control Regulations – Page 4 NO CHANGE Article IV – General Regulations – Pages 4-5 No substantive change – only some rephrasing for clarity (example: changing “harbor” to “waters of Southport” in this article and throughout the ordinance.
Article V – Anchoring, Mooring, & Security of Vessels – Pages 5-6 Sec. 4 - Detailed description of the process of dealing with abandoned vessels Sec 8 - information about mooring waiting lists.
Article VI – Rules concerning Moorings, Registration, Permits – Pages 7-12 This article was split out of old Article V. Much editing here for clarity and detail. Updated language dealing with the transfer of moorings The previously approved provision for mooring inspection every 4 years Several more items for the Mooring Application/permit form Changing dates for mooring payment to June 1 and permit sticker affixed to July. In both cases, the dates are moved back one month. Recommendations for radar reflector or reflective tape for floats not attached to shore Clarification of the provisions for obtaining a mooring permit and the need to have Harbor Committee approval if more than one mooring Provision for the regular annual permit fee cost even if no boat for one year; after that mooring is either converted to “rental”, “guest” or relinquished. Article VIII – Appeals – Page 12-13 NEW article removing Appeals from old Article I Detailed explanation of the steps in the appeals process including use of the Board of Appeals to appeal a decision of the Harbor Committee, after whicih an appeal goes to Superior Court.
Article IX – Violations – Page 13 No Change
Article X – Separability – Page 13 NEW article New Article: Notes that if any portion of the ordinance is invalid, the rest of the ordinance is not affected. February, 2010 |
